課程概述

World Trade Organization (WTO) Law covers a wide range of cross-cutting issues. In this semester, we will discuss disease control issues from WTO Law. Currently, the COVID-19 pandemic has unprecedented public health, social and economic impacts around the world. Since the beginning of the pandemic, WTO members have taken trade measures that had either restrictive or liberalizing character, including border control, travel ban and export restrictions of medicaments, medical supplies or food and temporary tariff suspension. Obviously, trade policy may play an important role in the control and alleviation of the pandemic.
Tentative topics to be discussed are as follows:
1. An Overview of Communicable Disease Control and WTO
2. Communicable Disease: Animal Disease and SPS Agreement
3. Communicable Disease: Agricultural Disease and SPS Agreement
4. An Overview of Non-Communicable Disease Control: cancer, obesity
5. Non-Communicable Disease: Alcohol Labelling and TBT Agreement
6. Non-Communicable Disease: Tobacco Control and WTO Law
7. Non-Communicable Disease: Environmental-related Disease/nuclear food
8. Access to Medicine: HIV, Compulsory Licensing and TRIPS Agreement
9. A Special Section on COVID-19(I): COVID-19 Measures
10. A Special Section on COVID-19(II): Export Restrictions, Exceptions and the Pandemic
11. A Special Section on COVID-19(III): Health Emergency and Security Exceptions
12. A Special Section on COVID-19(IV): TRIPS Waiver and TRIPS Article 73 Security Exceptions


 

課程目標
It is hoped that this course will enhance students’ professional knowledge and capability in WTO law and practice.  
課程要求
1. Class sessions will be mainly conducted by students’ presentations and class discussions.
2. Each student is required to present a chosen topic based on assigned papers (with other useful materials) and lead class discussion.
3. The Power-Point slides should be delivered to the instructor, teaching assistant and students via e-mail and ceiba three days prior to presentation.
4. Each student is required to share his/her term paper draft in class. The topic of the term paper needs to be approved in advance by the instructor.
5. A 10-page full-paper shall use blue book citation and be submitted at the end of the semester.
6. Attendance for all classes and active class participation are strongly encouraged. In no event, the participants should miss two classes without good reason.
7. The course evaluation will be based on four parts: class attendance (20%), class participation (25%), presentation (25%) and final term paper (30%).
8. All parts of the requirements shall be met by students. If one of the requirements is not met (e.g. without submitting the term paper or make paper presentation), no course grade will be given by the instructor.
